President Donald Trump essentially acknowledged that Rep. Ilhan Omar (D-Minn.) is under federal investigation by immigration authorities.
On Sunday, Trump posted a link to a JustTheNews.com article on Truth Social detailing how ICE officials refused to respond to the outlet’s Freedom of Information Act (FOIA) request citing ongoing “enforcement proceedings.”
The article discussed the outlet’s FOIA request filed in January “seeking the records pertaining to any investigations conducted by U.S. Immigration and Customs Enforcement into the allegations that Rep. Omar, who represents Minnesota’s 5th Congressional District, married a relative in order to help him remain in the country.”

In May, ICE responded they were exempt from revealing the information with a statement reading, “ICE has determined that the information you requested is being withheld in full pursuant to Title 5 U.S.C. § 552(b)(7)(A). Disclosure of any responsive records at this time could reasonably be expected to interfere with enforcement proceedings.”

The agency noted their FOIA exemption “applies to records or information compiled for law enforcement purposes when their release could disrupt such proceedings.”

According to JustTheNews, an exemption applies if there is a “‘reasonable likelihood’ of a pending or contemplated law enforcement proceeding,” and if release of the information would be “reasonably expected to cause some articulable harm to that proceeding.”
The Democrat Squad member didn’t respond to JustTheNews’ request for comment.
Rumors that Rep. Omar married her brother for immigration purposes have persisted since 2016, with claims suggesting she married Ahmed Nur Said Elmi in 2009 to help him become a US citizen.
In 2020, The Daily Mail spoke with a leader of the Somali community in Minneapolis, Minn., Abdihakim Osman, who claimed Elmi, Omar’s second husband, was indeed her brother; however, there has been no definitive evidence proving the claims.
